What is Mediation?

Gillespie, Shields & Associates

Mediation is a process that is called upon when people wish to avoid litigation or entering into a courtroom battle.  When people are in conflict over a legal matter and they need to reach a resolution, they may choose to enter into mediation.  People may choose to mediate disputes involving:

  • family law (divorce, child custody, child support, alimony, etc.)
  • employment law (discrimination, harassment or wage claims)
  • business law (contracts violation or partnership disputes)
  • probate law (wills, trusts and estates)

Mediation & Family Law

People who are going through contentious family law matters often find that they are struggling to reach an agreement because they are emotional.  Family law issues can be very traumatic and are sensitive in nature, which is why disputes are likely to arise or even escalate.  People who are involved in conflicts over family law matters may have children or may wish to avoid lengthy courtroom proceedings so they will choose to mediate through their problems together.  During mediation, involved parties will meet with a professional mediator who will guide discussions and help the parties reach mutually beneficial decisions.

Having a mediator is very helpful for people who are involved in all types of legal arguments because mediators serve as unbiased third parties who minimize emotional outbursts and remarks.  By working with mediators, people often find that they are able to reach resolutions on amicable terms, which lessens their stress and individual frustrations.  People are then able to move forward with their decisions without entering into further disputes or confrontations.

Another great thing about mediation is that parties will be presented with options they may not have thought of before.  Mediators are able to listen to both sides of the story, which enables them to provide neutral suggestions and solutions.  This can be very effective for parties who are struggling to reach agreements.
