What is Arbitration?
Arbitration is a process that is entered into by people who are involved in a legal dispute. Arbitration may involve conflicts over business, probate, employment or family law issues. When people decide to move forward with arbitration, they will be able to avoid complex litigation and will also be able to avoid going through lengthy court room proceedings. Many people choose arbitration over litigation because it is cost effective, saves time and is more flexible.
How Does Arbitration Work?
Once people are involved in a legal dispute, such as a divorce, they may choose to enter into arbitration. When this happens, an arbitrator will oversee the case and will serve as a private, unbiased third party. Unlike litigators, arbitrators are not bound by judicial law. Instead of basing their decisions on the law, they will make decisions that are in the best interest of the involved parties. While making decisions, they always will exercise their best judgment.
During arbitration, the arbitrator will carefully review the case. He or she will also review individual circumstances surrounding the legal matter, such as finances. After close consideration, the arbitrator will make a final decision known as an “award”. The award is a legally binding, inflexible decision which means that it cannot be changed unless one of the involved parties files an appeal. The award is just as binding and effective as a judicial ruling
It is important for people to know that unlike mediation, where involved parties are able to work together to reach decisions, the final outcome of arbitration proceedings will depend entirely upon the arbitrator. Also, when people partake in mediation, they can end the process at any time. However, when people participate in arbitration, the process will not end until an award decided upon by the arbitrator.
