Preparing for Mediation

If you are about to enter into mediation to resolve issues pertaining to legal matter involving family, business, probate or employment law, here are some helpful tips that will help you prepare for your first meeting.  By preparing for mediation, you will remain informed throughout the process and make the most out of discussions.

  1. Know that when you enter into mediation, it may take several sessions to reach an agreement with the other party, especially when mediating through emotional family law issues.  You may have to participate in several discussions before you are able to reach feasible agreements.   

  2. Try to understand what mediation is before you begin discussions.  Mediation is a process that allows parties to conduct important conversations and reach amicable resolutions.  During mediation, you will work with a mediator who is unbiased and who will not take sides.  This means that the outcome of mediation will depend on the effort you and the other party put into discussions.

  3. If you are going through mediation to settle financial conflicts, you should gather your financial information and paperwork ahead of time.  Anything that pertains to income, property, debt and legal contracts is important and will be discussed.

  4. Be aware that mediation can be very emotional and tumultuous, which is why it is best that children are not involved in proceedings.  Discussions during mediation should involve adult participants and a professional mediator.

  5. Before you decide on a mediator, conduct research.  Try to get referrals or read client testimonials before hiring a professional mediator.  Also, try to get a solid understanding of your mediator’s philosophy and prior case experience.  You want to make sure you obtain the services of a mediator that has the experience and knowledge it takes to effectively handle your case.
